exists <strong>only when all the following legal conditions are met cumulatively<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the child is <strong>removed to or retained in another State<\/strong>;<\/li>\n\n\n\n<li>the removal or retention takes place <strong>without the consent of the other parent<\/strong>;<\/li>\n\n\n\n<li>a <strong>right of custody<\/strong>, actually exercised under the law of the child\u2019s <strong>habitual residence<\/strong>, is breached.<\/li>\n<\/ul>\n\n\n\n<p>It is legally irrelevant whether the parent involved is the mother or the father.<br>Good intentions, emotional reasons, or subjective motivations <strong>have no legal relevance<\/strong>.<\/p>\n\n\n\n<p>What matters exclusively is <strong>the applicable law and the objective legal act<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">What Must Be Understood from the Outset<\/h4>\n\n\n\n<p>International child abduction is <strong>not a family disagreement<\/strong> and <strong>not an extension of divorce proceedings<\/strong>.<\/p>\n\n\n\n<p>It is an <strong>urgent international legal mechanism<\/strong>, governed by the <strong>Hague Convention on the Civil Aspects of International Child Abduction<\/strong>, adopted on 25 October 1980, ratified by Romania and applicable in a large number of States worldwide.<\/p>\n\n\n\n<p>In these cases, <strong>time, legal strategy, and specialized expertise are decisive<\/strong>.<br>A procedural error or unjustified delay may result in the <strong>irreversible loss of the child\u2019s return<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Purpose of the Hague Convention<\/h4>\n\n\n\n<p>A frequent misconception concerns the scope of the Hague Convention.<\/p>\n\n\n\n<p>The Convention <strong>does NOT decide<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>child custody;<\/li>\n\n\n\n<li> parental fault;<\/li>\n\n\n\n<li>which parent is more suitable.<\/li>\n<\/ul>\n\n\n\n<p>The <strong>sole purpose<\/strong> of the Hague Convention procedure is:<\/p>\n\n\n\n<p><strong>the prompt return of the child to the State of habitual residence<\/strong>,<br>so that the <strong>competent courts of that State<\/strong> may rule on custody and the child\u2019s best interests.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">The Central Legal Concept: Habitual Residence<\/h4>\n\n\n\n<p>In nearly all international child abduction cases, <strong>habitual residence<\/strong> is the decisive legal issue.<\/p>\n\n\n\n<p>Habitual residence is <strong>not<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the child\u2019s nationality;<\/li>\n\n\n\n<li>the registered domicile;<\/li>\n\n\n\n<li>the place of a temporary stay or visit.<\/li>\n<\/ul>\n\n\n\n<p>Habitual residence refers to the place where the child:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>had the <strong>center of daily life<\/strong>;<\/li>\n\n\n\n<li>attended school or kindergarten;<\/li>\n\n\n\n<li>enjoyed <strong>stability, continuity, and social integration<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>The determination of habitual residence is often <strong>the core dispute<\/strong> in Hague Convention proceedings.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">The One-Year Time Limit Under the Hague Convention<\/h4>\n\n\n\n<p>The Convention establishes a <strong>crucial time threshold<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Application filed within one year<\/strong> from the abduction \u2192 <strong>return of the child is the rule<\/strong>;<\/li>\n\n\n\n<li><strong>Application filed after one year<\/strong> \u2192 the court may refuse return <strong>if the child is proven to be settled<\/strong> in the new environment.<\/li>\n<\/ul>\n\n\n\n<p>Many cases fail <strong>not because the law is unfavorable<\/strong>, but because <strong>action was taken too late<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">When May the Return of the Child Be Refused?<\/h4>\n\n\n\n<p>Refusal of return is <strong>exceptional<\/strong> and strictly regulated.<\/p>\n\n\n\n<p>A court may refuse return <strong>only if clearly demonstrated<\/strong>, for example, in cases involving:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a <strong>grave income,<\/li>\n\n\n\n<li>perceived advantages of another country<\/li>\n<\/ul>\n\n\n\n<p><strong>do NOT justify refusal<\/strong> under the Hague Convention.<\/p>\n\n\n\n<h4
